1. a) Have never been subject to tariff regulation, except incidental activities, by either the Commission or the Federal Communications Commission (FCC); or
2. b) Have been preemptively detariffed in both jurisdictions by the FCC (e.g., customer premises equipment, enhanced services, and installation and maintenance of inside wiring).

Each carrier is required to have on file with the Chief Clerk of the Commission a description of each nonregulated activity offered by the carrier. This description is to be included in the carrier's cost allocation manual. Nonregulated activities include those that:
