1. a) This Part applies to the owner or operator of an agrichemical facility who requests, pursuant to 415 ILCS 60/19(9), Department issuance of a written authorization for land application of agrichemical-contaminated soil or groundwater. The contaminated soil or groundwater must be the product of the environmental cleanup of agrichemical spill sites at:

2. 1) agrichemical facilities,

   1. 2) in transit locations from an agrichemical facility to the field of application, or

3. 3) the field of application.

   1. b) This Part does not apply to the land application of contaminated soil or groundwater to any land other than farmland.
   2. c) This Part does not apply to spill sites at which the contaminated soil exhibits a characteristic of hazardous waste as defined in 35 Ill. Adm. Code 721.120 through 124.
