1. a) A facility shall not employ an individual as a nursing assistant, habilitation aide, home health aide, psychiatric services rehabilitation aide, or child care aide, or newly hired as an individual who may have access to a resident, a resident's living quarters, or a resident's personal, financial, or medical records, unless the facility has inquired of the Department's Health Care Worker Registry and the individual is listed on the Health Care Worker Registry as eligible to work for a health care employer. (Section 3-206.01 of the Act)
2. b) Sufficient staff in numbers and qualifications shall be on duty all hours of each day to provide services that meet the total needs of the residents. At a minimum, at least one staff member shall be awake, dressed, and on duty at all times.
3. c) The facility shall provide an administrator as set forth in Subpart B.
4. d) The facility shall provide activity personnel as set forth in Section 330.1310(b).
5. e) The facility shall provide dietary personnel as set forth in Sections 330.1910 and 330.1920.
6. f) Facilities that care for intellectually disabled or discharged psychiatric residents shall be required to employ a social worker. The social worker shall devote at least 40 hours per week in a facility that cares for 75 or more residents. Facilities that care for fewer than 75 residents shall have a social worker who may be assigned other duties or shared with other facilities.
