Ill. Admin. Code tit. 77, § 295.800 – Probationary License

a) The Department may issue a probationary license within 90 days after receipt of a completed application for a regular license. Circumstances in which a probationary license shall be issued include, but are not limited to:
1. 1) The applicant has not been previously licensed under the Act;
2. 2) The establishment is not in operation at the time the application is made; (Section 40 of the Act)
3. 3) The applicant is a sheltered care, intermediate care, or skilled care facility converting beds to assisted living; or
4. 4) Ownership of an establishment is transferred from the person named in the license to any other person. (Section 50 of the Act)
b) A probationary license shall be valid for 120 days unless sooner suspended or revoked in accordance with Section 295.1000 of this Part.
c) Within 30 days prior to the termination of a probationary license, the Department shall fully and completely review the establishment and, if the establishment meets the applicable requirements for licensure as set forth in the Act and this Part, shall issue a regular license.
d) If the Department finds that the establishment does not meet the requirements for licensure but has made substantial progress toward meeting those requirements, the license may be renewed once for a second probationary license for a period not to exceed 120 days from the expiration date of the initial probationary license.
