1. a) The provisions from which the variance is granted is not statutorily mandated;
2. b) The granting of the variance would not be contrary to the public welfare; and
3. c) Application of the rule from which the variance is granted would, in the particular case, be unreasonable or unnecessarily burdensome.

The Director may grant variances from this Part in cases in which the Director finds that:
