1. a) The provision from which the variance is granted is not statutorily mandated;

2. b) The granting of the variance would not be contrary to the public welfare; and

   1. c) The rule from which the variance is granted would, in the particular case, be unreasonable or unnecessarily burdensome.

The Director may grant variances in individual cases from this Part when:
