a) The Director may grant variances from this Part in cases in which:

1. 1) The applicable provision is not statutorily mandated;

2. 2) No party will be injured by the granting of the variance; and

   1. 3) The rule from which the variance is granted would, in the particular case, be unreasonable or unnecessarily burdensome.
   2. b) An approval for a variance may be revocable, may be granted for a limited period of time or may be granted subject to the conditions as the Director may prescribe.
