1. a) Small Contracts

   The provisions of Sections 1150.1000, 1150.1100, and 1150.1200 of this Part do not apply to architectural, engineering, and land surveying contracts of less than $25,000.

2. b) The provisions of Sections 1150.1000, 1150.1100, and 1150.1200 of this Part do not apply to the procurement of architectural, engineering and land surveying services by the Department:

   1. 1) when the Department determines in writing that it is in the best interests of the State to proceed with the immediate selection of a firm; or
   2. 2) in emergencies when immediate services are necessary to protect the public health, safety and general welfare from the adverse effects of mining.
