1. a) The operation of such devices is not required for purposes of occupational safety or health, or for the control of toxic substances, odor nuisances or other regulated pollutants; and
2. b) Such devices are operated for the duration of any period for which an ozone advisory, alert or emergency has been declared pursuant to 35 Ill. Adm. Code 244.

The operation of any oil fired or natural gas fired after-burner and capture system used to comply with this Part of any section thereof is not required during the period of November 1 of any year to April 1 of the following year provided that:
