1. a) Is operated for commercial application; or
2. b) Stores or accumulates fertilizers prior to distribution to retail sales outlets, including a unit that is a warehouse or bulk terminal.
3. c) Despite subsections (a) and (b), this Subpart does not apply to any unit exempt under Section 616.105.

This Subpart applies to any new unit for the storage and handling of fertilizers that is located wholly or partially within a setback zone or regulated recharge area and that:
