1. a) the loan applicant submitted a Funding Nomination Form and the project is on the Project Priority List;
2. b) the Agency has approved the loan applicant's Project Plan pursuant to Sections 365.320 and 365.330; and
3. c) the documents required by Section 365.350 have been submitted and approved by the Agency.

The Agency may, subject to the availability of funds, issue a loan agreement authorizing the initiation of construction of a project or activity listed in Section 365.130 when:
