b) Any natural person may qualify to be a vehicle scrappage manager if he or she meets the following criteria:

1. 1) Is at least eighteen years old;
2. 2) Is an American citizen or legal alien; and
3. 3) Has never been convicted of or had a final judgment entered against him or her in any State or federal court for a violation of State or federal air pollution laws or regulations, for fraud or for felony theft.

c) Each natural person who wishes to become a vehicle scrappage manager must successfully complete the training course offered by the Agency.

1. 1) The Agency will offer the training program annually, based on need. The Agency will provide advance public notice of the time, date and location for each training course.

2. 2) The curriculum for the Agency training course will include the following subjects:

   1. A) The development of acceptable vehicle scrappage plans;
   2. B) Methods for CER calculations;
   3. C) Procedures for modeling and measurement of emissions;
   4. D) Collector vehicle and vehicle parts rebuilder provisions;
   5. E) Proper vehicle disassembly and recycling of vehicle parts; and
   6. F) Methods for proper recycling and/or disposal of residual materials and wastes derived from the retirement of vehicles.
3. 3) For the applicant to be authorized to manage a vehicle scrappage program, he or she must pass the examination administered by the Agency at the conclusion of each Agency training course, which will test each applicant's knowledge of the material covered in the training course.
4. 4) If an applicant fails the Agency-administered examination specified in subsection (c)(3) of this Section on the first attempt, he or she shall have the opportunity to take and pass the examination one additional time. If an applicant fails the Agency-administered examination on the second attempt, he or she may reapply for approval to manage a vehicle scrappage program, subject to the same requirements as a first time applicant.
5. 5) The Agency will offer the examination biannually, if needed. When an Agency-administered examination is to be offered at a different time than immediately following the Agency training course, the Agency will provide advance public notice of the time, date and location for the examination.

g) Each natural person submitting an application pursuant to this Subpart shall sign and date the following statement as part of his or her application:

I certify that I satisfy all of the qualification requirements for a vehicle scrappage manager and that the information submitted in this application is, to the best of my knowledge and belief, true, accurate and complete. I am aware that I may be subject to enforcement under the Environmental Protection Act and may be disqualified from conducting vehicle scrappage activities in the State of Illinois pursuant to 35 Ill. Adm. Code 207 if any information submitted in this application is determined to be false or misleading.
