a) The following motor vehicles are exempt from the requirements of Section 241.113 of this Subpart and are not considered to be covered fleet vehicles or included in the 10 motor vehicle count criterion of a covered fleet, whether or not such motor vehicles are part of a covered fleet which is subject to the control requirements of this Subpart:

1. 1) Motor vehicles held for lease or rental to the general public;
2. 2) Motor vehicles held for sale by dealers (including demonstration vehicles);
3. 3) Motor vehicles used for manufacturer product evaluations or tests;
4. 4) Law enforcement vehicles and other emergency vehicles;
5. 5) Motor vehicles not registered to operate on public roadways;
6. 6) Motor vehicles in excess of 26,000 lbs GVWR;
7. 7) Motor vehicles determined by the Secretary of Defense of the United States to be exempt from the program for national security reasons;
8. 8) Antique vehicles as defined in Section 1-102.1 of the Illinois Vehicle Code [625 ILCS 5/1-102.1];
9. 9) Motorcycles, motor driven cycles, and motorized pedal cycles as defined in Sections 1-147, 1-148, and 1-148.2 of the Illinois Vehicle Code [625 ILCS 5/1-147, 1-148, and 1-148.2];
10. 10) Motor vehicles that are not capable of being centrally fueled; and
11. 11) Motor vehicles that are under normal conditions garaged at a personal residence, unless they are, in fact, centrally fueled.
