781—9.32(556) Claim of another state to property in the custody of the treasurer of state.

1. 9.32(1)  If property is received by the division and the division is aware that the property is subject to a superior claim of another state, the division may:

   1. a. Report and deliver the property to the other state; or
   2. b. Return the property to the holder so that the property may be paid or delivered to the other state.
2. 9.32(2)  Except for an agreement to indemnify the state of Iowa, no formal agreement shall be required of the division to undertake such transfer to the correct state.

This rule is intended to implement Iowa Code section 556.20.
