Settlements may be negotiated during an investigation or after the commencement of a contested case proceeding. Negotiations will be conducted between the board’s legal counsel and any person subject to the investigation or contested case proceeding or the person’s legal representatives. A settlement will be in writing and is subject to approval of the board. If the board declines to approve a proposed settlement, the settlement will be of no force or effect.
