281—102.12(280) Level-two investigator’s duties.

1. 102.12(1)  Upon referral by the designated investigator, the level-two investigator appointed, contracted, requested or retained under subrule 102.5(2) shall review the report of abuse and the designated investigator’s report, if any, promptly conduct further investigation and create a written narrative report. The level-two investigator’s report shall state:

   1. a. Conclusions as to the occurrence of the alleged incident; and
   2. b. Conclusions as to the applicability of the exceptions to physical abuse listed in rule 281—102.4(280); or
   3. c. Conclusions as to the nature of the sexual abuse, if any; and
   4. d. Recommendations regarding the need for further investigation.
2. 102.12(2)  The written report shall be delivered to the designated investigator as soon as practicable.
3. 102.12(3)  The level-two investigator shall exercise prudent discretion in the investigative process to preserve the privacy interests of the individuals involved. To the maximum extent possible, the level-two investigator shall maintain the confidentiality of the report.
