1. 1. A person who is an alien commits an offense if all of the following are true:

   1. a. The person has been charged with or convicted of an offense under this chapter.
   2. b. A judge has issued an order under this chapter for the person to return to the foreign nation from which the person entered or attempted to enter.
   3. c. The person failed to comply with the order.
2. 2. An offense under this section is a class “C” felony.
