An adult day services program shall not knowingly admit or retain a participant who meets any of the following criteria:

1. 1. Is under the age of eighteen.
2. 2. Requires routine three-person assistance with standing, transfer, or evacuation.

3. 3. Poses a danger to the participant, other participants, or the adult day services program staff. “Pose a danger” may include but is not limited to the following situations:

   1. a. The participant chronically elopes despite intervention.
   2. b. The participant is sexually or physically aggressive or abusive.
   3. c. The participant’s verbal abuse is unmanageable by staff.
   4. d. The participant is in the acute stage of alcoholism, drug addiction, or mental illness.
