This part shall not apply to:

1. (1) Health care providers who do not accept medicare insurance;
2. (2) Qualified patients who have already received a diagnosis of dementia or mild cognitive impairment; and
3. (3) Qualified patients who are unable to undergo a cognitive assessment due to a physical or mental impairment or disability.
