Rule 570-38-4-.04. Minimum Required Insurance
(1) No passenger carrier to which this Subchapter is applicable shall operate or hold itself out to be a passenger carrier without: (a) First complying with Rule 570-38-2-.05 of these Rules, provided however that the passenger carrier shall be required to comply with subparagraph (b) of this paragraph in lieu of complying with paragraph (8) of that Rule; (b) Securing and having in effect a policy of insurance by an insurance company licensed to do business in this state, which policy provides for the protection of passengers and the public against injury proximately caused by the negligence of such motor carrier, its servants, or its agents in an amount equal to or greater than the following: Schedule of Minimum Required Coverage Type of Equipment / Vehicle Limit for bodily injury to or death of one person Limit of bodily injuries to or death of all persons injured or killed in any one accident (subject to limit for injuries to one person) Limit for loss or damage in any one accident to property of others (excluding cargo) Passenger vehicle with a seating capacity of 12 people or less $100,000.00 $300,000.00 $50,000.00 Passenger vehicle with a seating capacity of more than 12 people $100,000.00 $500,000.00 $50,000.00 (c) Complying with all other state and federal laws, rules, and regulations relating to required insurance. (2) The Department may waive some or all of the requirements of paragraph (1) of this Rule if it determines that the carrier is financially capable of self-insuring against losses in amount equal to or greater than the minimum levels of insurance otherwise required by paragraph (1).
