Rule 120-2-2-.20. Initiation of Adjudication

1. 1. An adjudication is initiated when a party files a petition.

2. 2. The petition may be sent to the Department by either:

   1. a. Mail: ATTN: Administrative Procedure Division,

      Department of Insurance

      2 Martin Luther King Jr. Dr.

      716 West Tower, Floyd Bldg.

      Atlanta, GA 30334, or

   2. b. Email: AdminProc@oci.ga.gov

3. 3. The petition must contain the following:

   1. a. addressed to the Commissioner;
   2. b. signed by the petitioner or his/her counsel;
   3. c. a brief statement of the nature of the proceeding,
   4. d. the identity of known parties,
   5. e. the jurisdiction under which the adjudication is initiated,
   6. f. a brief statement of the general allegations of fact and the issues to be adjudicated,
   7. g. the legal authority that constitutes a basis for the adjudication, and
   8. h. a brief statement of the nature of the relief sought.
