1. (1) If the terms of a provider contract require or allow the department to withhold a portion of the provider's payment to establish a fund for significant maintenance, repairs, or upgrades to state-owned or leased facilities, the department shall deposit all such withheld payments into the Administrative Trust Fund, which shall be used for such purposes pursuant to lawful appropriation.
2. (2) This section is repealed July 1, 2002.
