Any person who violates or fails to comply with ss. 246.201-246.231 or any of the rules promulgated thereunder:

1. (1) For the first conviction, is guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.
2. (2) For a second or subsequent conviction, is guilty of a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.
3. (3) May have his or her license revoked.
