Any person who violates any of the provisions of ss. 246.011-246.151 shall be punished as follows:

1. (1) For the first conviction, he or she is guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.
2. (2) For a second or any subsequent conviction, he or she is guilty of a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.
