Re: Bar Association Fee Survey

Dear Mr. Brown:

Please be advised that I am currently the President of the South Suburban Bar Association. Our Board has requested that we investigate the possibility of publishing and conducting a fee survey for disclosure to our members. I wish to have the Justice Department conduct a business review on this issue. Please be advised that what the Bar Association wishes to accomplish is to send out a fee survey to all its members and to compile the results. This would report the total number of surveys mailed and the number of responses. We then would simply put the reported fee range for the different areas of practice. We may, if allowed to, put an average.

It is imperative that you understand that at no time will there be a recommendation by the Bar Association as to a particular amount of money to charge for a fee. In addition, there will be absolute confidentiality as to the results. In fact, we would request that anyone answering the survey not put their name on their answers. There certainly would be no listing in the results as to who is charging what amount of money.

We as an association are seeking your advice to avoid litigation or problems that may arise from doing this. We do not wish to do anything that is unlawful or which will jeopardize our position by

way of being sued. We simply seek to ask whether this is possible

and if so, what is the best way to accomplish it. In addition,

whether there are any guidelines in our conducting this survey.
