1.0 Spot Recreational Possession Limit .
(PenaltySection7Del.C.§936(b)(2))
- 1.1 Unless otherwise authorized, it is unlawful for any recreational fisherman to take and reduce to possession more than 50 spot per day (a day being 24 hours) from the tidal waters of this State. Any spot taken from the tidal waters of this State that is not immediately returned, without unnecessary injury, to the same waters from which it was taken, is deemed taken and reduced to possession for purposes of this subsection.
- 1.2 Unless otherwise authorized, it is unlawful for any recreational fisherman to have in possession more than 50 spot at or between the place the spot were taken and the fisherman's personal abode or temporary or transient place of lodging.
2.0 Exceptions
- 2.1 Vessels engaged in recreational fishing may possess more than 50 spot but the number of spot onboard the vessel shall not exceed the product of 50 multiplied by the number of individuals onboard.
- 2.2 Holders of a Delaware fishing guide, charter boat or head boat license may possess more than 50 spot between the license holder’s business location and the personal abode of the license holder.
