1. (a) The Commissioner shall grant an active license to a conditional licensee who does all of the following:

   1. (1) Pays any fees or costs associated with obtaining a background check.
   2. (2) Provides financial and ownership documentation for review and approval.
   3. (3) Submits an attestation signed by a bona fide labor organization stating that the licensee has entered into a labor peace agreement with such bona fide labor organization.
   4. (4) Is in compliance with all local laws including local zoning, fire codes and building codes.
   5. (5) Submits any additional information or documentation required by the Commissioner.
2. (b) The Commissioner may refuse to grant an active license to a conditional licensee if the requirements of subsection (a) of this section are not met.
