1. (a) Except as authorized by this chapter, it is unlawful for any person to do any of the following:

   1. (1) Manufacture, deliver, or possess with intent to manufacture or deliver a controlled substance in a Tier 2 quantity.
   2. (2) Possess a controlled substance in a Tier 2 quantity.

2. (b) (1) Violation of subsection (a)(1) of this section is a class C felony.

   1. (2) Violation of subsection (a)(2) of this section is a class E felony
