Before an individual may receive a prescription for medication to end life in a humane and dignified manner a consulting physician or consulting APRN must do all of the following:

1. (1) Evaluate the individual and the individual’s relevant medical records.

2. (2) Confirm, in writing, to the attending physician or attending APRN that the individual meets all of the following:

   1. a. Has a terminal illness.
   2. b. Has decision-making capacity or provide documentation that the consulting physician or consulting APRN has referred the individual for further evaluation under § 2510C of this title.
   3. c. Is making an informed decision.
   4. d. Is acting voluntarily.
