6401.1 Each individual eligible to receive services shall meet all of the following requirements:

1. (a) Is a District of Columbia resident;
2. (b) Has a gross income at or below one hundred percent (100%) of the Federal Poverty Level (FPL);
3. (c) Has resource limits of $2,600 for an individual and $3,000 for an individual and his/her spouse;
4. (d) Owns no property other than the home in which he or she lives and a car;
5. (e) Is not eligible for the traditional Medicaid program under Titles XIX and XXI of the Social Security Act;
6. (f) Is HIV-infected;
7. (g) Does not reside in a long-term care facility, mental health facility, or penal institution; and
8. (h) Has completed an informed consent form at the time of application.
