6104.1 A person shall enter into a permanent guardianship subsidy agreement with CFSA prior to receiving a permanent guardianship subsidy.

6104.2 The permanent guardianship subsidy agreement is the sole and complete statement of the funds and services a person shall receive from a permanent guardianship subsidy related to the child(ren) named therein.

6104.3 A permanent guardianship subsidy agreement shall include at least:

1. (a) The amount of the permanent guardianship subsidy;
2. (b) The duration of the permanent guardianship subsidy; and
3. (c) A statement as to whether District of Columbia Medicaid shall be provided.

6104.4 A permanent guardianship subsidy agreement shall terminate:

1. (a) By the terms of the agreement;
2. (b) Based on information learned through a review in accordance with § 6105;
3. (c) If the permanent guardian dies or is removed from the position; or
4. (d) Upon the earlier of the child's:
5. (1) Eighteenth (18th) birthday;
6. (2) Residence outside the home of the permanent guardian, unless the permanent guardian can demonstrate that he or she retains financial responsibility for the child and the child is attending a residential school;
7. (3) Marriage;
8. (4) Death; or
9. (5) Enlistment in the military.

6104.5 The recipient shall notify CFSA within two (2) weeks of:

1. (a) The occurrence of any of the factors listed in § 6104.4(d); and
2. (b) Any change of address.

6104.6 Nothing in these rules shall be read as prohibiting a person from receiving any service from CFSA to which the person is otherwise entitled or which is otherwise available.
