5004.1 Beginning on November 1, 2026, and for each subsequent year, each railroad carrier operating in the District shall, no later than November 1 of each year, pay to the Department the amount stated in the notice of assessment issued by the Department under § 5003.1.

5004.2 The payment shall be made in accordance with any instructions included in the notice of assessment issued by the Department under § 5003.1.

5004.3 Payment of the fee shall be considered to be timely made if:

(a) It is received by the Department on or before November 1 of the same calendar year in which notice has been given under § 5003.1; or,

(b) It is sent to the Department by first-class United States Postal Service mail in an envelope that is properly addressed, stamped, and postmarked on or before November 1 of the same calendar year in which notice has been given under § 5003.1, and is received by the Department not more than ten (10) days after the date of the postmark.
