1528.1 Except as noted in §1528.2, all functions of the Office of Adjudication are to be performed personally by the Administrative Law Judge (ALJ). The following powers shall be nondelegable:

1. (a) Presiding over hearings;
2. (b) Admitting evidence;
3. (c) Ruling on motions; and
4. (d) Rendering final decisions in a case.

1528.2 The staff of the Office of Adjudication may perform the following functions:

1. (a) Receive papers for filing;
2. (b) Issue summonses;
3. (c) Maintain the calendar for the Office of Adjudication;
4. (d) Perform internal administrative functions of the Office of Adjudication;
5. (e) Contact the parties when necessary concerning changes in schedules; and
6. (f) Exercise any other powers or duties delegated by the ALJ.
