Delinquency Determination and Notice
Authority: The Director of the Department of Consumer and Regulatory Affairs, pursuant to authority set forth in Article III of Reorganization Plan No. 1 of 1983, effective March 31, 1983, and Mayor’s Order 83-92, effective April 7, 1983; section 6(h) of An Act To provide for the abatement of nuisances in the District of Columbia by the Commissioners of said District, and for other purposes, approved April 14, 1906 (34 Stat. 114; D.C. Official Code § 42-3131.06(h) (2010 Repl.)); Mayor’s Order 2002-33, effective February 11, 2002; and section 104 of the Department of Consumer and Regulatory Affairs Civil Infractions Act of 1985, effective October 5, 1985 (D.C. 6607.1 The Director shall identify vacant buildings in the District of Columbia and compile an initial list of building addresses that includes the name and addresses of the owners, if known.
6607.2 The Director shall update the vacant building list on a quarterly basis.
6607.3 Within forty-five (45) days after the effective date of the Act, the Director shall make a determination of delinquency of registration or fee payment for buildings that are vacant buildings on the date of the initial listing, and shall provide the owner with:
- (a) The notice of delinquency including information on the right to an administrative review of the determination; and
- (b) The registration form and the registration fee due.
6607.4 Within fifteen (15) days of the date of the quarterly listing of vacant buildings, the Director shall make a determination of the delinquency of registration or fee payment, and shall provide the owner with:
- (a) The notice of delinquency including information on the right to an administrative review of the determination; and
- (b) The registration form and the registration fee due.
