7005.1 This chapter provides regulations for developing air rights above public streets or alleys (“airspace”) in the District of Columbia.

7005.2 Under § 5 of the District of Columbia Public Space Utilization Act, approved October 17, 1968 (D.C. Official Code §§ 10-1121.01 et seq.), the Zoning Commission shall, after public hearing and after securing the advice and recommendations of the National Capital Planning Commission, review and approve all air space development.
