(a) For the purposes of this chapter, the term:
- (1) "Covered individual" means an individual who has submitted to a fingerprint-based background check as a condition of caring for children, persons with a disability, the elderly, or vulnerable adults, a security officer, special police officer, private detective, private detective agency, security agency, or other person responsible for protecting property, preventing theft, damage to real or personal property, assaults, disorder, or other illegal occurrences, or for purposes of licensure, appointment, commission, certification, registration, employment, or volunteer service with a participating agency pursuant to District law or regulation.
- (2) "FBI" means the Federal Bureau of Investigation.
- (3) "FBI Rap Back Service" means the FBI Next Generation Identification Record of Arrest and Prosecution Background Service.
- (4) "MPD" means the Metropolitan Police Department.
- (5) "Notification event" means an event, such as an arrest or other criminal activity when fingerprints are taken, that triggers a notification from the FBI Rap Back Service to the Metropolitan Police Department regarding a covered individual who has been subscribed to the FBI Rap Back Service.
- (6) "Participating agency" means a District government agency that requires a fingerprint-based background check and receives the results as a condition of caring for children, persons with a disability, the elderly, or vulnerable adults, a security officer, special police officer, private detective, private detective agency, security agency, or other person responsible for protecting property, preventing theft, damage to real or personal property, assaults, disorder, or similar illegal occurrences, or for purposes of licensure, appointment, commission, certification, registration, employment, or volunteer service.
