For the purposes of this chapter, the term:

1. (a)

   1. (1) "Clearly and conspicuously" means in larger type than the surrounding text, in contrasting type, font, or color to the surrounding text of the same size, or set off from the surrounding text of the same size by symbols or other marks, in a manner that calls attention to the language and is visually proximate to any request for the consumer's consent.
   2. (2) "Consumer" means any person who seeks or acquires, by purchase or lease, any goods or services.

Applicability of D.C. Law 22-235: § 301(b) of D.C. Law 22-235 provided that the creation of this section by § 202 of D.C. Law 22-235 is subject to the inclusion of the law’s fiscal effect in an approved budget and financial plan. Therefore that amendment has not been implemented.
