1. (a) A criminal history provider:

   1. (1) Shall, unless otherwise prohibited by District or federal law:

      1. (A) Provide the subject of a criminal record with a copy of the criminal history report the criminal history provider used or provided;
      2. (B) State the source of reported information and the date on which the information was received from the source in a criminal history report; and
      3. (C) Use 2 identifiers, such as date of birth and name, before reporting a person's criminal record; and

   2. (2) Shall not, unless otherwise required by District or federal law:

      1. (A) Provide information relating to the following:

         1. (i) A criminal record that has been expunged, sealed, or set aside; and
         2. (ii) A criminal record that the criminal history provider knows is inaccurate; or
      2. (B) Include criminal history information in a criminal history report if the criminal history information has not been updated to reflect changes to the criminal history information occurring 30 days or more before the date the criminal history report is provided.

Applicability of D.C. Law 24-284: § 301 of D.C. Law 24-284 provided that the creation of this section by § 202 of D.C. Law 24-284 is subject to the inclusion of the law’s fiscal effect in an approved budget and financial plan. Therefore that amendment has not been implemented.

Applicability

Applicability of D.C. Law 24-284: § 301 of D.C. Law 24-284 provided that the creation of this section by § 202 of D.C. Law 24-284 is subject to the inclusion of the law’s fiscal effect in an approved budget and financial plan. Therefore that amendment has not been implemented.

Section 7088 of D.C. Law 25-50 amended section 301 of D.C. Law 24-284 changing the applicability provision impacting this section to January 1, 2026. Therefore the creation of this section by Law 24-284 will be implemented on January 1, 2026.

Section 40(b) of D.C. Law 25-175 amended section 301 of D.C. Law 24-284 changing the applicability provision impacting this section to October 1, 2024. Therefore the creation of this section by Law 24-284 will be implemented on October 1, 2024.

Section 7290(a) of D.C. Law 25-217 amended section 40(b) of D.C. Law 25-175, amending section 301 of D.C. Law 24-284 making the creation of this section by section 202 of D.C. Law 24-284 applicable as of March 1, 2025.
