1. (a) The affirmative action plan shall contain a concluding statement that:

   1. (1) acknowledges that the ultimate responsibility for promoting and enforcing affirmative action rests with the appointing authority, who shall account for the success or failure of the plan;
   2. (2) acknowledges that every good faith effort to achieve the objectives and goals set forth in the plan has been made; and (3) attests that the agency's equal employment opportunity officer reports directly to the agency head.
2. (b) The concluding statement shall be signed and dated by the appointing authority.
