1. (a) A business facility applying for continuations of enterprise zone benefits, relocating from either a municipality's enterprise zone which has been designated under the provisions of section 32-70 of the Connecticut General Statutes, or a distressed municipality to an enterprise zone designated under the provisions of section 32-70 of the Connecticut General Statutes, shall show either:

(i) an increase in operations through the submission of a lease to the Commissioner that indicates a net increase of at least 100 square feet in the number of square feet being occupied in the new enterprise zone versus the amount of square feet currently occupied in the existing enterprise zone municipality or distressed municipality; or

   1. (ii) an increase in employment by a minimum of one new full time job, the existence of which shall be attested to on an applicant's pre-application.

      1. (a) Business facilities which fail to meet the requirements of subsection (a) of this section shall be deemed to be ineligible to receive enterprise zone benefits.
