Payment of compensation shall be paid from the Fund provided:

1. (a) A formal hearing is held and the Second Injury Fund, the Attorney General's Office, and Workers' Compensation Department, were noticed to attend.
2. (b) A finding and award is granted against the employer after notice to the employer.
3. (c) Ten days have passed from the date of notice of the award to the employer and the claimant has not received payment and the employer has not instituted an appeal.
4. (d) The claimant requests and is granted a supplemental order of payment against the Fund.
