The issue of an employer’s nonparticipation in a fact-finding or in response to a request for information by the Administrator may not be the subject of an appeal until notification of the nonparticipation and the right to appeal is noticed in a decision by the Employment Security Appeals Division established under section 31-237b of the Connecticut General Statutes.
