1. (a) If a proposed agency decision is made by a designee, the Director or Administrator, the designee shall forward the proposed decision to the Director or Administrator, as appropriate for a desk review. Following said desk review, the agency's proposed decision shall be submitted to the Commissioner for his review, if the proposed decision is for a discharge or the veteran requests a review under subsection (b) of this section.
2. (b) Any veteran subject to an administrative inquiry who disagrees with an agency decision may petition for a desk review or other review by the Commissioner or his designee.
3. (c) The Commissioner may order an informal conference.
4. (d) The Commissioner may deny or grant any such request and may thereafter, if granted, modify, reverse, or affirm the decision rendered.
5. (e) Granting a review may not create a contested case or any right of appeal for further review.
