(a) Applicability.
- (1) This section applies to all persons who use, produce, transport, store, possess or dispose of radioactive materials within the state.
- (2) This section shall not apply to any person to the extent such person is subject to regulation by the U.S. Nuclear Regulatory Commission.
- (b) Compliance; Granting Exemptions.Each person who uses, produces, transports, stores, possesses or disposes of radioactive materials within the state is required to comply with sections 22a-153-1 to 22a-153-150, inclusive, of the Regulations of Connecticut State Agencies, except as specified in section 22a-148(c)(2) of the Connecticut General Statutes, or where, pursuant to section 22a-154(b) of the Connecticut General Statutes, the commissioner, upon application therefor or upon the commissioner's own initiative, grants an exemption upon a finding that it does not constitute a significant risk to occupational and public health and safety.
(c) Exemptions.The following sources, uses and types of users are exempt from sections 22a-153-1 to 22a-153-150, inclusive, of the Regulations of Connecticut State Agencies:
- (1) Federal government agencies;
- (2) Excreta from individuals undergoing medical diagnosis or therapy with radioactive materials;
- (3) A material, product or use specifically exempted from licensing requirements by the NRC, the department or an Agreement State or authorized for distribution to persons exempt from license requirements; and(4) Other sources of radioactive material, upon a finding that such radioactive material does not constitute a significant risk to occupational and public health and safety.
