1. (a) A dispensary, producer, laboratory, research program, law enforcement or court official or the commissioner shall dispose of undesired, excess, unauthorized, obsolete, adulterated, misbranded or deteriorated marijuana in the following manner:

   1. (1) By surrender without compensation of such marijuana to the commissioner; or (2) By disposal in the presence of an authorized representative of the commissioner in such a manner as to render the marijuana non-recoverable.

2. (b) The person disposing of the marijuana shall maintain and make available in accordance with section 21a-408-72 of the Regulations of Connecticut State Agencies a separate record of each such disposal indicating:

   1. (1) The date and time of disposal;
   2. (2) The manner of disposal;
   3. (3) The brand name and quantity of marijuana disposed of; and (4) The signatures of the persons disposing of the marijuana, the authorized representative of the commissioner and any other persons present during the disposal.
