A child shall be eligible for the birth-to-three system, if the child is:

1. (1) experiencing a significant developmental delay in one or more of the following areas:

   1. (A) cognitive development;
   2. (B) physical development, including vision or hearing;
   3. (C) communication development;
   4. (D) social or emotional development;
   5. (E) adaptive skills; or
2. (2) diagnosed as having a physical or mental condition that has a high probability of resulting in a significant developmental delay.
