As used in this part 3, unless the context otherwise requires:

1. (1) Confectionery means candy, cakes, cookies, and glazed fruit.
2. (2) Department means the department of public health and environment or its authorized representative.
3. (3) Mix means the pasteurized unfrozen combination of all ingredients of a frozen dairy dessert with or without fruits, fruit juices, chocolate, cocoa, confectionery, nut meats, flavor, or harmless color.
