1. (1) The state department shall compile any information that relates to the implementation of this article 1.2 and is required pursuant to 45 CFR 1355.44 concerning the adoption and foster care analysis and reporting system.

2. (2)

   1. (a) On or before July 1, 2027, and every odd-numbered year thereafter, the judicial department shall provide the following information for the prior two-year period to the state department:

      1. (I) The number of Indian children involved in dependency and neglect proceedings;
      2. (II) The dates out-of-home placement were ordered for Indian children in protective custody;
      3. (III) The ratio of Indian children to non-Indian children in protective custody; and
      4. (IV) The number of cases that were transferred to a tribal court pursuant to sections 19-1.2-118 and 19-1.2-119.

   2. (b) On or before September 15, 2027, and every odd-numbered year thereafter, the state department shall compile the following information for the prior two-year period:

      1. (I) Which tribes the Indian children who were in protective custody were members of or eligible for membership in;
      2. (II) The number of Indian children in foster care;
      3. (III) The number of Indian children placed in adoptive homes from the child welfare system; and
      4. (IV) The number of available placements and common barriers to recruitment and retention of appropriate placements.
   3. (c) No later than December 1, 2027, and every even-numbered year thereafter, the state department shall report the findings of the information compiled pursuant to subsections (2)(a) and (2)(b) of this section to the house of representatives health and human services committee, the house of representatives judiciary committee, the senate health and human services committee, and the senate judiciary committee, or their successor committees.
3. (3) Notwithstanding the requirement in section 24-1-136 (11)(a)(I), the report required pursuant to this section continues indefinitely.
