1. (1) Except as otherwise provided in this section, the court's jurisdiction pursuant to this article 1.2 in a case involving an Indian child is concurrent with the Indian child's tribe.

2. (2) The Indian child's tribe has exclusive jurisdiction in a case involving an Indian child if:

   1. (a) The Indian child is a ward of a tribal court of the tribe; or
   2. (b) The Indian child resides or is domiciled on the tribe's reservation.
3. (3) Notwithstanding subsection (2) of this section, the court has temporary emergency jurisdiction over an Indian child who is taken into protective custody pursuant to section 19-1.2-110 or 19-3-201, or part 4 of article 3 of this title 19.
