(b) Records of proof of entry.

1. (1) Exporters must obtain and maintain records of an official or customary commercial nature that demonstrate the arrival of the U.S. Agricultural Commodities exported in connection with the GSM-102 program in the country or region that was the intended country or region of destination of such commodities. At the Director's request, the Exporter must submit to CCC records demonstrating proof of entry. Records demonstrating proof of entry must be in English or be accompanied by a certified or other translation acceptable to CCC. Records acceptable to meet this requirement include an original certification of entry signed by a duly authorized customs or port official of the importing country, by an agent or representative of the vessel or shipline that delivered the U.S. Agricultural Commodity to the importing country, or by a private surveyor in the importing country, or other documentation deemed acceptable by the Director showing:

   1. (i) That the U.S. Agricultural Commodity entered the importing country or region;
   2. (ii) The identification of the export carrier;
   3. (iii) The quantity of the U.S. Agricultural Commodity;
   4. (iv) The kind, type, grade and/or class of the U.S. Agricultural Commodity; and
   5. (v) The date(s) and place(s) of unloading of the U.S. Agricultural Commodity in the importing country or region.
2. (2) Where shipping documents (e.g., bills of lading) clearly demonstrate that the U.S. Agricultural Commodities were shipped to the destination country or region, proof of entry verification may be provided by the Importer.
